Complaints Resolution Policy

In the interest of our clients, we have implemented a formal complaints policy. This policy ensures that any complaint that you may have will be dealt with fairly and speedily and by competent staff.

Given the complexity of the financial services environment, we must point out that we will only be in a position to accept responsibility for such complaints as pertain directly to our service to you. In all other matters, we will endeavour to facilitate complaints that you may have by directing them to the most appropriate facility. In the event of a complaint not being handled to your satisfaction by this office, then you will have recourse to the Ombud or such other recourse as may be advised by your attorney.

Conflict of Interest Management Policy

Ngenious Business Solutions (Pty) Ltd (“Ngenious”) is an authorized Financial Services Provider (“FSP”) in terms of Financial Advisory and Intermediary Services Act 37 of 2002 (“FAIS”). As required by FAIS, as set out in Board Notice 58 of 2010, Ngenious must implement and maintain a Conflict of Interest Management Policy.

 

Coupled with this requirement, Ngenious is committed to providing financial services to clients, with integrity, honesty, transparency and in a manner that always put our client’s interests first.

Promotion of Access to Informaton Policy

Under the Promotion of Access to Information Act 2000 ("PAIA"), private companies are required to grant access to records they hold if those records are required by the requestor to exercise or protect any legal right the requestor enjoys under the law. Privacy Statement

Ngenious Business Solutions (Pty) Ltd (“Ngenious”), is committed to integrity in our dealings with our clients, employees and service partners (“customers”). This commitment extends to personal information about our customers that we might possess or acquire. We strive to protect the personal information under our control and take certain precautions to help maintain the security and accuracy of that data.

We do not guarantee that the Site will be secure or free viruses and or bugs. We are not responsible for any loss or damage suffered caused directly or indirectly by viruses, spamware or bugs.

Phishing and Spoofing

Please note Ngenious will NOT send any unsolicited e-mails.  If you do receive and unsolicited email from Ngenious that requests you to provide personal confidential information (such as your credit card number, username, or password), or that asks you to verify or confirm your Ngenious information by clicking on a link, it is most likely that the e-mail was sent by a "phisher" or "spoofer."

 

Ngenious will never ask for this type of information in an e-mail, and we strongly recommend that you do not respond to these e-mails and that you do not click on the link. Responding to “phishing” places you and your personal information at risk.

 

South African Law Applies

These terms of use, their subject matter and their formation, are governed by South African law. You and we both agree that the courts of South Africa will have exclusive jurisdiction to resolve any dispute.
